1. Introduction

Welcome to the Winlucks Customer App (the "Platform"). These Terms and Conditions govern your use of the Platform, operated by Winlucks LLC-FZ ("Winlucks," "we," "us," or "our"). By accessing or using the Platform, including associated applications on iPhone, iPad, Android, and any mobile application, you agree to comply with and be bound by these terms. If you do not agree, you must cease using the Platform immediately.

2. User Registration and Account Requirements

2.1 Registration

Users must provide accurate and complete registration details, including a valid email address and contact information.

2.2 Age Restrictions

Only individuals aged 18 or older are permitted to register for an account. Users under the age of 18 must have parental or guardian supervision and consent to use the Platform.

2.3 Account Responsibility

Users are responsible for maintaining the confidentiality of their account credentials and for all activities conducted through their account.

3. Use of the Platform

3.1 Permitted Use

Users must use the Platform solely for lawful purposes and in compliance with these terms.

3.2 Prohibited Activities

Users may not engage in activities that disrupt or interfere with the functionality or integrity of the Platform. Unauthorized access to another user's account is strictly prohibited.

4. Ordering and Payment

4.1 Placing Orders

• Users can browse and place orders from Merchants listed on the Platform.
• All orders are subject to Merchant availability, and confirmation is provided upon successful order placement.
• Users must review their order details carefully before confirming payment. Errors cannot be corrected once payment is processed.

4.2 Payments

• Payments can be made via the Platform using supported payment methods, including credit/debit cards and Winlucks Coins.
• Users are responsible for ensuring sufficient funds are available in their selected payment method.
• Winlucks is not responsible for payment processing delays or errors caused by third-party providers.

5. Customer Responsibilities

5.1 Accurate Information

Users must provide accurate personal information during registration and while placing orders. Issues arising from incorrect or incomplete details are the user's responsibility.

5.2 Order Collection

Users are responsible for collecting orders from the designated Merchant location. Orders not collected within the specified timeframe may be canceled, and payments may not be refunded.

5.3 Prohibited Activities

Users are prohibited from:

• Engaging in fraudulent activities, such as using stolen payment methods.
• Misusing the Platform to harass, threaten, or defame others.
• Attempting to reverse-engineer or tamper with the Platform's code or functionality.

6. Cancellations, Returns, and Refunds

6.1 Order Cancellations

Users may cancel orders within the cancellation window specified by the Merchant. Beyond this period, cancellations are not permitted unless explicitly authorized.

6.2 Returns and Exchanges

Merchants may offer return or exchange policies at their discretion. Users must refer to the Merchant's terms before making a purchase. Winlucks is not responsible for enforcing these policies.

7. Winlucks Bonus Reward Program/ Giveaway Draws and Prize Redemption

7.1 Winlucks Bonus Reward Program and Giveaway Draws

• Winlucks Bonus Reward Program Draw: When you make a purchase from Winlucks listed merchants, you may receive Winlucks Bonus Reward Program Tickets that will automatically enter you into the Reward Draw.
• Giveaway Draw: You may also enter Giveaway Draws without making a purchase by claiming a free ticket via the App.
• By participating in these draws, you agree to the specific Winlucks Bonus Reward Program Draw and Giveaway Draw Terms and Conditions.

7.2 Prize Redemption

• If you win a prize, you will receive a notification through the App with redemption instructions.
• You can be redeemed the prize within the specified time period and at designated Winlucks listed merchants.
• Unredeemed prizes are transferable one time to another customer, and once you transferred then the recipient customer can only be redeemed within the specified time period and at designated Winlucks listed merchants.
• Winlucks and the merchants are not responsible for lost, stolen, or unclaimed prizes.

8. Data Protection and Privacy

8.1 General Data Use

Winlucks is committed to protecting user data and complies with applicable data protection laws in the UAE. Personal information collected on the Platform is used for order processing, customer support, and other purposes outlined in the Privacy Policy.

8.2 Use of Customer Data for Promotions

By using the Platform, you agree that Winlucks may use your personal data, including your name, photos, location, and Winlucks Bonus Reward Program winner details, for promotional purposes. These promotions may include displaying this information on Winlucks' app, website, banners, notices, and through Merchants. If you do not agree to this, you must refrain from using the Winlucks app or web platform.

8.3 User Rights

Users have the right to access, modify, or delete their personal data by contacting Winlucks support.

9. Account Suspension and Termination

9.1 Suspension by Winlucks

Winlucks reserves the right to suspend or terminate user accounts for violations, including fraudulent activities, misuse of the Platform, or repeated complaints.

9.2 Termination by User

Users may terminate their account by submitting a request through the Platform. Termination does not absolve users of outstanding obligations.

10. Limitation of Liability

Winlucks is not liable for:

• Issues arising from Merchant products or services.
• Delays or errors caused by third-party providers.
• Indirect or incidental damages resulting from Platform use.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved under UAE jurisdiction, with arbitration conducted under the rules of the Dubai International Arbitration Centre (DIAC).

12. Modification of Terms

Winlucks reserves the right to modify or update these Terms and Conditions at any time. Any changes will be communicated through the App or via email.

Your continued use of the App after any such modifications constitutes your acceptance of the revised Terms and Conditions.

13. Third-Party Services

The App may contain links to third-party services or websites. Winlucks is not responsible for the content, privacy practices, or terms of service of these third-party services.

You agree to review the terms and conditions of third-party services before engaging with them.

14. Dispute Resolution

In the event of a dispute between you and Winlucks, both parties agree to attempt resolution through mediation or informal negotiations before seeking formal legal recourse.
